DISTANCE SALES AGREEMENT

ARTICLE 1- SUBJECT

The subject of this agreement covers the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers – Regulation on Distance Contracts regarding the sale and delivery of the product sold by the SELLER to the BUYER, the characteristics and sales price of which are specified below.

ARTICLE 5- GENERAL PROVISIONS

5.1. BUYER declares that he/she has read and is informed about the basic characteristics, sales price and payment method of the contracted product specified in Article 4 and all preliminary information regarding delivery and has given the necessary confirmation electronically.

5.2. The contracted product will be delivered to BUYER or the person/organization at the address indicated by him/her within the period specified in the preliminary information depending on the distance of BUYER’s place of residence for each product, provided that it does not exceed the legal 30-day period. This period may be extended by a maximum of 10 days provided that the consumer is notified in writing.

5.3. If the contracted product is to be delivered to a person/organization other than BUYER, SELLER cannot be held responsible for the person/organization to be delivered not accepting the delivery.

5.4. SELLER is responsible for the delivery of the contractual product in a sound, complete manner and in accordance with the specifications specified in the order. Provided that it is based on a justified reason, SELLER may supply goods or services of equal quality and price to CONSUMER before the expiration of the performance obligation arising from the contract.

5.5. In order to deliver the contractual product, it is necessary to confirm this contract electronically and pay the price of the contractual order. If the product price is not paid or is canceled in bank records for any reason, SELLER is deemed to be relieved of its obligation to deliver the product.

5.6. If SELLER cannot deliver the contractual product within the specified time due to force majeure or extraordinary circumstances such as adverse weather conditions or interruption of transportation that prevent transportation, it is obliged to notify the BUYER of the situation. In this case, BUYER may exercise one of the following rights: cancellation of the order, replacement of the contractual product with a similar one, if any, and/or postponement of the delivery period until the elimination of the preventing situation.

If the BUYER cancels the order, the amount paid will be returned to the BUYER within 10 days.

5.7. In the event that the BUYER’s payment obligation under this contract is not fulfilled in any way, the SELLER may initiate enforcement proceedings, file a debt lawsuit and resort to other legal means in order to collect the uncollected product price, together with the interest to be applied based on the price of the product on the delivery date and the interest rates stipulated in the contract.

ARTICLE 6 – RIGHT OF WITHDRAWAL

According to Article 7, paragraph 4, subparagraph c of the Regulation on Distance Contracts titled Right of Withdrawal; The consumer cannot exercise the right of withdrawal in goods prepared in line with the consumer’s requests or clearly his/her personal needs. In addition, the consumer does not have the right of withdrawal in contracts regarding the delivery of goods that are not suitable for return due to their nature and are at risk of rapid deterioration or whose expiration date may have passed.

ARTICLE 7- AUTHORIZED COURT

In the implementation of this contract, Consumer Arbitration Committees and Consumer Courts in the place of residence of the BUYER or SELLER are authorized up to the value declared by the Ministry of Industry and Trade.
